Abortion rights in Spain are under review, much to the disquiet of many pro-choice groups across Europe.

The Spanish government have really shaken up a stir with their plans to restrict abortion rights in Spain. It is causing protests in Madrid, amid international calls to respect women’s abortion rights. An Irish pro choice group is adding their weight by protesting outside a Spanish embassy in Dublin. The pro choice group want to lobby for their Hispanic counterparts. The restriction of abortion rights in Spain make it almost as restrictive as current pregnancy termination laws in Ireland. Spaniards are now facing prospects of travelling to France for an abortion.

Why are there plans to restrict abortion rights in Spain?

Abortion Advice.ie understand that the Spanish government have a commitment to reform abortion in their party manifesto. They are implementing an electoral promise in order to fulfill this manifesto. But many politicians in Europe are stunned. They have denounced the Spanish government plans to restrict abortions rights in Spain. Justice Minister Alberto Ruiz-Gallardón could take a leaf from the Irish government. Promising your electorate is one thing, but delivering is another as Phil Hogan of Fine Gael could probably surmise himself. Alberto Ruiz-Gallardón however is sticking to restricting abortion rights in Spain

What other protests have taken place

Outside of Ireland, there has been a similar but larger embassy protests in Belgium. There is also the Parisian World March for Women in France, with planned protests in the capital. These concerted efforts are an attempt to stifle the changing landscape on abortion worldwide. In Lithuania, the government there are tabling abortion restrictions. But the Spanish government are in a strong position as Mariano Rajoy’s Popular Party has an absolute majority. The final outcome on abortion rights in Spain is not guaranteed. It is likely that Spanish embassies across the world will see more international protests.

Children tend to soak up material without much investigation. They are prone to misplaced understanding, which makes abortion lessons all the more difficult. An external education agency giving a one sided view in school, will result in polemical backlash by alternative groups. Very often the abortion lessons message can become obscured. Words like may become will, and unlikely becomes never. This is what makes use of language terms so important. Abortion Advice.ie assesses the situation…

What was reported about these abortion lessons

The news report was very critical of the scare tactic approach taken by an outside education agency. The agency’s abortion lessons seemed designed to engineer children clear of pregnancy terminations. The journalist reports the sex ed tone with the opening three sentences:

“A rape victim can’t become pregnant. Abortion damages a woman’s internal organs. Abortion destroys a woman’s mental health”.1

1 Peter McGuire, Irish Times, A lesson in abortion, 4 February 2014, http://www.irishtimes.com/news/education/a-lesson-in-abortion

Abortion Advice.ie do not condone this sex ed approach with school children. Its too negative, a bit misleading and a touch imperative. The use of semantics could be greatly improved upon. The choice of language employed can be all it takes.

What kind of abortion lessons could be considered?

News reports are sometimes prone to sensationalism to sell papers. Editorial-ship is a difficult path to tread as papers may run risk of a tabloid label. The education agency may too feel misrepresented by the article. But even still choosing non imperative language is always a safer approach. Women do become pregnant from rape, but conception tends to be at a low rate. Some levels of abortion can run higher risks to internal organ damage, but it is not an absolute given. Post abortion symptoms may translate in personal regret. This regret might lead to possible mental health problems, but we have no agreed statistics to verify this.

Are abortion lessons necessary

The recent Guttmacher Institute report on induced abortion shows a continued decline in abortion in America. This might be due to effective abortion lessons encompassing sex education measures. It might also be a result in widespread availability of contraception. It may even possibly be the result of health regulation. If abortion lessons improve women’s lives, then Abortion Advice.ie are in favour. If abortion lessons take away a woman’s freedom & dignity, well we’d question the motives there.

Her now former boyfriend John Welden however, did not share her dream. He used his position in a family fertility clinic to procure & tamper with abortifacient, to pass onto his girlfriend as antibiotics. This story shows just how vulnerable women can be in relationships to abortion risks. John Welden has owned up to the sinister plot, but only after the death of Ramee Jo Lee’s baby.

What motivated John Weldon to slip an abortifacient?

John Welden wanted the best of both worlds & more. He was already in a long term relationship with another woman before he met Remee Jo Lee according to reports. He concealed this to his new girlfriend, and then panicked when Ramee became pregnant. He was in dread that his long term girlfriend would find out. He never considered the abortion risks, and concocted what he believed where well laid plans. Using his father’s medical practice, he obtained through forgery abortifacients, to bring about a resultant abortion procedure. His unsuspecting pregnant girlfriend never knew that she was taking abortion risks destined to end her dream.

The sinister plot unravels

John Weldon was obviously too panick stricken by his own self made dilemma to see that his motives were sinister, and his plot was sure to be found out. Remee found herself suffering from severe cramps around 7 weeks into her pregnancy, and went straight to a hospital. It was there, a doctor told her that she had lost her baby due to self induced abortion methods. This was a serious situation, and Ramee went to the police to report what had happened. When Ramee later confronted John, the conversation was secretly recorded. his confessions led to John’s arrest, and ultimately to his 14 year prison sentence. Ramee has to live with this betrayal and her loss. No doubt she will need a lot of post abortion care.

The nation is divided on the issue, as the abortion changes are being packaged into a gender equality bill. It seems like a straight forward enough case… give women equality & parity of esteem. Nobody can fault the ideology, women are capable of ruling the roost. Look at Margaret Thatcher for example, and how she became Britain’s iron lady. But is pregnancy termination adjusting necessary for the French gender equality bill? Abortion Advice.ie looks at the present scenario…

History of the French abortion law

In 1975, French minister Simone Veil introduced legalized abortion in France for up to 12 weeks gestation for women in distress. The caveat was, a pregnant women must claim to be in distress. This criteria acted as a safety valve for abortion on demand. Simone Veil was then the minister of health and relaxed access to contraceptives in late 1974. Termination was a crime in France until the French abortion law was passed in 1975. Simone Veil is singularly credited for legalizing pregnancy termination procedures there. The then minister for health went against the Church in Rome and the Grand Rabbi of France of her Judaic religion. Simone Veil proved herself to be an iron lady in France.

The present gender equality bill

Today, Simone Veil’s abortion bill is under review. The French government are bringing in a raft of changes to promote gender equality in the daily life of women in France. Women are still under represented at almost every area of French commerce & politics. The proposed gender equality bill will penalize political parties, educational institutions, self interest organizations and businesses who fail to employ women in equal measure. Equality measures include the right to terminate pregnancies, or to bear a child regardless of distress or not. It could alleviate business fears on down time due to maternity leave.

But if the Irish Government’s plans to roll out pregnancy termination is fully realized, we can expect a higher than average medical fee. This will be particularly true if suicidal ideation comes into play. A woman in Ireland might claim the need for an abortion on mental health grounds. If she is denied access to an abortion, then she has recourse to a review panel for reconsideration. The review panel will be made up of a team of medics. The Irish health board might end up paying top dollar for consultant fees.

Irish abortion cost breakdown

The Irish government are set to grant €120 per hour per private consultant in fees for abortion regarding suicide ideation assessments. The public hospital doctors will not be given the same financial package, which may be a source of public expenditure comfort. The UK gives us some idea of projected cost break down for a straightforward pregnancy termination processes. For a pregnancy test, it costs £5. For a one to one consultation over the phone or face to face, it costs £82. A medical abortion costs £464, while a surgical abortion costs between £562 and £2000 depending on gestation stage. The later the pregnancy, the higher the costs for termination. An Irish abortion cost price structure might then be higher.

There is more financial figures to come

As the UK have a gestation limit of 24 weeks, we cannot forecast any late term abortion rates based in Britain. It is possible that an Irish abortion cost plan will continue to climb for late term pregnancy terminations. But there maybe exceptions. In some countries, late term abortions may be sponsored by medical business interests. This is an ethically questionable venture. Abortion Advice.ie definitely do not consider this option for any crisis pregnant woman. Any late term abortion costs in Ireland will probably be absorbed by the Irish tax payer and health insurance providers. If not, its hard to see this health service become a reality.
The latest abortion logjam involves real concerns by the Irish College of Psychiatrists. A near prohibition like order on engaging with review panels has been made to its members. These panels were established with the purpose of assessing suicidal ideation in pregnant women. The College feels that the Protection of Life During Pregnancy Act needs clear clinical guidelines. Until such guidelines are in place, psychiatrists should abstain from participation with the review panels. This presents an abortion logjam for the government keen to deliver a broader healthcare system.

When might this abortion logjam be ironed out?

The government’s Department of Health have implied that the abortion logjam can be sorted early this year. The clinical guidelines are at an advanced stage. But given the clout of the College of Psychiatrists, acceptance of them cannot be a given. Considering the nature of their genuine concerns for their members as well as their clients, the guidelines might require serious revision. The government have being pushing so hard to roll out abortion in Ireland, at the expense of any real dialogue with medical professionals.

What are the genuine concerns of psychiatrists?

The concerns centre on issues in ethics, and areas the termination bill impinges on. The government’s seemly carte blanche approach to abortion portrays a tunnel vision mentality on the issue. What is at stake here is integrity. Does the psychiatrist sign off pregnant women on suicide ideation for the sake of an abortion? Should there be recourse to a second opinion? Do the guidelines have any secure foundation, without risk of changing haphazardly? There is the issue of psychiatric training for GPs and gynecologists as well. The abortion logjam in Ireland looks set to continue into the future, until the Department of Health begin a meaningful dialogue…

The criteria being either a serious risk to a woman’s physical health, or rape. This makes Argentine abortion law almost as restrictive as Ireland’s heretofore pregnancy termination ban. A similar crisis has lead to a supreme court ruling on abortion in both countries, with regards a rape of a 14 year old girl. Ireland had her x case, whereby a 14 year old girl was raped by a neighbour. In Argentina, a 14 year old girl was raped by her step father, resulting in what Abortion Advice.ie calls, Argentina’s x case ruling.

Argentina’s landmark abortion ruling

Argentina’s x case is not an exact match on Ireland, but the court ruling there is a landmark decision. It over turns an earlier court ruling against abortion for the rape victim. Hitherto now, the young girl was expected to carry her pregnancy to full term and give the child up for adoption. A pregnancy termination procedure request was originally overruled. Argentine abortion law is undergoing much revision of late. It is no longer considered a punishable crime to have an abortion. It is also no longer necessary by law to seek court approval. But strangely in Argentina’s x case, this seems to be what was sought.

Argentina and Ireland are both now less restrictive on abortion

While countries like Spain, Russia and the USA are clamping down on abortions, Ireland and Argentina are doing the apposite. That said, Ireland is poised to become infinitely more accessible for abortion than Argentina. Ireland’s protection of life during pregnancy bill holds no gestation limits for a termination. It also includes suicidal ideation as grounds for an abortion. The only restrictions remaining are fetal abnormalities, and rape. No doubt the Argentine abortion law will be hitting the headlines again with the changing landscape on abortion.

The abortion law reform is akin to a bull fight with only one winner.

While termination laws are set to be implemented in Ireland as of the beginning of the New Year 2014, Spain is implementing abortion law reform. This is part of the changing landscape on abortion worldwide, and the tactics are being refined with each battle. Spain’s Justice Minister Alberto Ruiz-Gallardón, has put forward a bill named the Protection of Life Conceived and Rights of Pregnant Women. The proposed law has created uproar among the pro choice advocates who have taken to the streets. This termination legislation reflects Ireland’s Protection of life during Pregnancy Bill. What does the abortion law reform mean for women in Spain? Perhaps it will engender abortion tourism…

Abortion tourism

Spain has for many decades become accustomed to easy access to pregnancy termination procedures. But the abortion law reform is set to restrict all this. Many advocates for equal rights feel that Spanish women will be forced to travel elsewhere for a pregnancy termination. This is currently the case for Irish women who have to travel to England, creating abortion tourism there. Danielle’s tragic termination story paints an all too common picture. Pro life groups in Spain no doubt welcome the restrictive measures, secured as part of a political party electoral manifesto. Justice Minister Alberto Ruiz-Gallardón has delivered on the party’s electoral promise. Their political manifesto on abortion law reform is secured.

What changes does the abortion law reform bring about?

The Protection of Life Conceived and Rights of Pregnant Women bill is designed to put more focus on the life of the unborn. Spanish women may seek an abortion if there is grave risk to their physical or mental well being up to 22 weeks of gestation. They can also seek a pregnancy termination from rape through to 12 weeks of gestation. Like Ireland’s Protection of Life During Pregnancy Bill, there are safeguards included. The safety measures entail seeking abortion advice from a number of recognized medical professionals. All in all, the measures in the Spanish abortion law reform bill will make it harder to obtain a pregnancy termination.

The weekly TV series gave Danielle her chance to give a frank testimony on her life as a teenager in Dublin many years ago. Danielle was a nonconformist teenage girl, and she attended a concert with her then boyfriend. They were both sexually active and took responsible precautions. The night of the concert the contraceptive method failed, and both partners became aware of this. The next day, Danielle procured a morning after pill, to overcome the initial failure. This too was unsuccessful, and abortion information became the next logical option.

The abortion dilemma in England

Abortion Advice.ie comes accross many situations like Danielle. The story is fairly familiar, and what happens on the emotional level is that panic sets in. Danielle went to England with her boyfriend, and opted for a surgical abortion procedure. She wanted to get back to Ireland as soon as possible. Danielle received some injections, and a pregnancy termination was then performed. Afterwards Danielle was allowed leave the clinic to head home to Ireland. At the airport she felt cramps in her stomach and began to experience labour pains. Her abortion was not fully complete, and an ambulance was called to the airport.

The outcome for Danielle

Thankfully the medical intervention at a hospital in England prevented any serious consequences from the pregnancy termination. But had Danielle got on her plane, things may have been very different. Danielle now feels that there should be services on abortion in Ireland. There is strong logic to this argument, and her story calls for an Irish rethink. But there is another underlying message. Many women who find themselves pregnant rush into a panic. This anxiety can betray their very lives. Abortion Advice.ie believe that a more restrained reaction can be beneficial in times of distress.

This was communicated to Irish politicians demanding revisions to the Protection of Life During Pregnancy bill. It comes as no real surprise with the local elections looming in 2014. Enda Kenny has asserted that abortion on demand is not a model for Ireland. The Irish prime minister introduced regulation and restriction in accordance with a Supreme Court judgement on the X case. Fatal foetal abnormality was not part of that judgement, and was not included in the recent Irish abortion bill.

The push for fatal foetal abnormality inclusion for abortion

Despite the prime minister’s stance, there is growing pressure on Ireland to cater for fatal foetal abnormality. There are even consultations expected soon on Abortion reforms in Ulster. A separate clarification call comes from the UN on Ireland’s Protection of Life During Pregnancy Bill. Under normal circumstances, the Irish government would debate this. But politics is an uncertain business. A referendum call on abortion from the Nation Women’s Council of Ireland has been requested. There has also been hints of a referendum call by the BPAS (The British Pregnancy Advisory Service). This means that nationally & internationally, Enda Kenny’s wisdom is being questioned.

Fatal foetal abnormality care

Some groups against abortion believe that there could be more emphasis on fatal foetal abnormality care. They feel this may alleviate stress women face with certain pregnancy failure. Such groups also think it may help women cope with inevitable infant mortality soon after giving birth. It remains to be seen if such a measure is to be considered for debate. Fatal foetal abnormality care is a relatively new concept, resulting from increased maternal awareness on fetal development. It is not likely that Enda Kenny will consider this option at present. As far as Mr. Kenny is concerned, fatal foetal abnormality is off the Irish government’s agenda.
